In January 2020, the DOT published a notice of proposed rulemaking (NPRM) that included a proposal to add oral fluid drug testing as an approved method for DOT drug testing. The NPRM sought public comments on the proposal, including comments on the accuracy and reliability of oral fluid drug testing and its potential impact on the transportation industry.
In August 2020, the DOT announced that it had completed a pilot program to evaluate the use of oral fluid drug testing in DOT drug testing. The pilot program included testing over 8,000 oral fluid specimens from commercial drivers, and the results were used to evaluate the accuracy and reliability of oral fluid drug testing.
Based on the results of the pilot program and the public comments received, the DOT issued a final rule on May 2, 2023 (Effective June 1, 2023) that outlines the requirements and procedures for oral fluid drug testing in DOT-regulated industries. Once fully implemented, oral fluid drug testing will be an additional approved method for DOT drug testing alongside urine testing.
It is important to note that it will still take some time for the lab approvals to occur, before it is fully implemented.
